The requirement for a deeper probe, did not make a case for grant of pre-arrest bail : P&H HC

Case: Manjit Singh vs State of Punjab

Forum: Punjab & Haryana High Court

Facts

The Petitioner filed an application seeking anticipatory bail after an FIR was registered where it was alleged that  tax was being evaded by ensuring that there was no checking or verification of the documents or goods, while being transported to & from State of Punjab. The Petitioner contended that he has not been named in the FIR. It was a result of the disclosure statement of the co-accused that the name of the Petitioner surfaced.

Key points

The Court upon considering the complexity of the issue, the tax impact on the chain of sellers and purchasers, the material as on date with the investigating agency, the multi dimensional aspects involved needing a deeper probe, no case was made out for grant of pre-arrest bail. The petition was thus dismissed.
