Karnataka HC grants liberty to petitioner to file for revocation of GST registration cancellation.

Facts

The Petitioner filed a writ petition with a prayer inter alia to quash the order of ‘cancellation of registration’ passed by the Assistant Commissioner of Commercial Taxes, Bengaluru.

The advocate for the Petitioner submitted that Petitioner seeks to file the necessary application under the provisions of the CGST Act and seeks revocation of cancellation of registration. It was further prayed that since registration has been cancelled in the month of March, 2020, directions may be issued to the Assistant Commissioner of Commercial Taxes, Bengaluru to consider the application for revocation immediately.

Accordingly, the petition was disposed off, granting liberty to the petitioner to file necessary applications seeking revocation of cancellation of registration. It was further instructed that, if such application is submitted, the Assistant Commissioner of Commercial Taxes, Bengaluru, shall consider the same and pass appropriate orders, as expeditiously as possible.
