Gujarat HC orders Respondent authority to release seized goods from it’s custody.

Case: Arpit Parcel Service v/s State Tax Officer

The Petitioner is engaged in the business of parcel services based upon E-bill. A truck operated by the Petitioner was seized by Respondent authority on the ground that the goods were found without E-way bill. A show cause notice in Form GST MOV-10 was issued to the Petitioner.

The Petitioner moved the Hon’ble HC seeking an order for the release of its truck with the goods seized by Respondent authority.

Key points

The Hob’ble HC held that upon the Petitioner depositing the amount of tax and penalty and furnishing a bank guarantee of the balance amount. The Respondent authority would immediately release the goods as well as truck. The HC granted the Respondent authority the liberty to proceed with the case in accordance with law.
